The petitioner seeks bail in Magadh Medical P.S. Case No. 269 of 2019, registered for the offence under Section 30(a) (d) of Bihar Prohibition and Excise Act.

40 kg Mahua flower has been recovered from the shop of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.02.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of recovery and period of custody, the bail petition of petitioner is allowed. Let the above

Patna High Court CR. MISC. No.42224 of 2021(2) dt.26-10-2021 2/2 named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. S.J. II cum Special Judge Excise, Gaya in connection with Magadh Medical P.S. Case No. 269 of 2019.
