JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 The petitioner apprehends his arrest in connection with Kotwali P.S.Case No. 185 of 2017 registered under Sections 120B, 406, 420, 504 and 506 of the Indian penal Code. Allegation against the petitioner is that in spite of taking consideration money, he has not executed the sale deed. Submission of learned counsel for the petitioner is that as a matter of fact, whole consideration amount has not been deposited earlier as such sale deed could not be executed but now sale deed has been executed.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks from the date of receipt of a

No.518 of 2019(7) dt.01-04-2019 2/2 copy of this order and prays for regular bail along with the documents of execution of sale deed upon which court below shall consider the same and if satisfies with the document, he will release the petitioner on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Patna in connection with Kotwali P.S. Case No. 185 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, otherwise he is free to pass any other order or orders which will be deemed fit and proper.
