The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, petitioner and his family members caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against all the accused persons and no specific overt act has been alleged against the petitioner who happens to be husband of the deceased. No substantive evidence has been collected during course of investigation to suggest the implication of this

Petitioner is in custody since 25.2.2021. Considering the facts of the case as also the fact that there is general and omnibus allegation against the petitioner and no overt act has been alleged against him and the police after investigation submitted charge sheet under section 306/201 of the IPC, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Muzaffarpur West in Sahebganj Police Station Case No. 58 of 2012.
