This application for anticipatory bail arises out of Nokha P.S. Case No. 184 of 2018, disclosing offences under Sections 409, 419 and 420 of the Indian Penal Code. One Taregna Devi was appointed as Anganwari Sevika. On a complaint that Taregna Devi died several years ago and in her place, one Lalsa Devi is fraudulently working and receiving the emoluments, the present criminal case came to be registered. The petitioner is the husband of Taregna Devi. Learned counsel, appearing on behalf of the petitioner, has submitted that it is incorrect to say that the said Taregna Devi is no more and any person, other than Taregna Devi, is working as Anganwari Sevika. Considering the nature of accusation, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in Nokha P.S. Case No. 184 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
