2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 413, 414 & 34 of the IPC and Section 135 of the Customs Act.

3. The case of the prosecution is that altogether 45 quintal of betelnut was recovered from a truck. The driver and owner were apprehended. The name of this petitioner was disclosed by the apprehended persons.

4. Learned counsel for the petitioner submits that in view of Section 135 of the Customs Act, the maximum punishment will be seven years. It has also been submitted by the learned counsel that driver and owner of the vehicle has been

5. Learned APP appearing for the state has vehemently opposed the bail and has submitted that the anticipatory bail petition of the petitioner was rejected in the year 2015 and it has much delayed in surrendering.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jalalgarh P.S. Case No. 16 of 2010 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-V, Purnea.
