The petitioner seeks bail in anticipation of her arrest in connection with Kharagpur P. S. Case No. 41 of 2016 dated 25.02.2016 instituted for the offences under Sections 420, 465, 468 and 471 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981.

It appears that on behalf of the petitioner, somebody else was caught writing the examination. Learned counsel for the petitioner fairly submits that no defence can be urged on her behalf except for

Patna High Court Cr.Misc. No.69336 of 2018(2) dt.19-12-2018 2/2 stating before this Court that she is a woman, having children and it would serve no purpose to send her to jail. Regard being had to the gender of the petitioner only, the petitioner, above-named, is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur P. S. Case No. 41 of 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
