2. The petitioner apprehends his arrest in a case registered for the offence under Sections 20(b)(ii)(b), 23(b), 25 of the N.D.P.S. Act.
3. On a tip off, a raid was conducted and 18 kg. of Ganja was recovered loaded on two motorcycles, whereas drivers & pillion riders of these motorcycles fled away from spot after seeing the police party. The police party also recovered a mobile phone, on screen of which, photo of petitioner was found and on that basis, petitioner has been made accused in this case.
4. Learned counsel for the petitioner submits that no
Patna High Court CR. MISC. No.35468 of 2024(4) dt.11-09-2024 2/2 incriminating article has been recovered from the possession of this petitioner and has been made accused only on suspicion. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Sessions Judge, N.D.P.S., East Champaran, Motihari in connection with Chhauradano (Mahuwa) P.S. Case No. 427 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
