2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304B and 120B/34 of the Indian Penal Code.

3. The case of the prosecution is that daughter of the informant, namely, Resmi Kumari (deceased) was married to one Ajit Kumar @ Gaya Prasad three years ago. It is further alleged that she was subjected to cruelty on account of nonfulfillment of demand of dowry. It is further alleged that her inlaws had administered poison to her due to which she died. Hence, the present FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the petitioner is mother-in-law of the deceased and she has been living separately from her son. It is further submitted that there is general and omnibus allegation against the petitioner. Moreover, the petitioner is languishing in judicial custody since 24.12.2024

5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has one criminal antecedent in which she is on bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Roshanganj P.S. Case No. 243 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya.
