The petitioner apprehends his arrest in connection with Complaint Case No. 761 of 2016 in which cognizance has been taken under Section 406 and 420 of the Indian Penal Code and 138 of the Negotiable Instrument Act.

Learned counsel for both parties have submitted that the matter between the petitioner and the O.P.No. 2 has been settled amicably and a joint compromise petition has been filed by both parties before the court of learned ACJM-9 at Motihari. Learned counsel, in support of his argument, has filed

Patna High Court CR. MISC. No.30174 of 2019(7) dt.30-09-2019 2/2 a supplementary affidavit before this Court and a copy of which has already been served upon the O.P.No. 2.

In view of the above and taking into consideration the fact that a joint compromise petition has been filed before the learned court below, let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari in connection with Complaint Case No. 761 of 2016; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioners will abide by terms and conditions mentioned in the compromise petition appended as Annexure-3 to the supplementary affidavit.
