The present MJC has been preferred for compliance of order dated 05.07.2011 in CWJC No.2608 of 2008. A supplementary show-cause of Sub-Divisional Magistrate, Banka (opposite party no.7) is on record annexing the order dated 15.10.2019/18.10.2019 passed by the Collectorcum-Circle Officer, Barahat by which after recording that the

Patna High Court MJC No.3086 of 2015(4) dt.07-08-2023 2/2 said Plot No.141, Khesra 601 is recorded as Gair Majarua Malik Parti Kadim, the Civil Surgeon, District Health Center Banka was exonerated of the encroachment charges with further direction to the petitioner that if aggrieved can move in appeal. Considering the aforesaid facts no contempt is made out. The petitioner is free to challenge the order. Accordingly, MJC No.3086 of 2015 stands disposed of.
