JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Sono P.S. Case No. 149 of 2018, dated 30.05.2018, instituted for the offences under Sections 147, 446, 341, 323, 325, 307, 354, 379, 504 and 506 of the Indian Penal Code.

After some arguments, Mr. Pankaj Kumar Sinha, the learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the Court below and seek regular bail.

Patna High Court Cr.Misc. No.69375 of 2018(2) dt.19-12-2018 2/2 The petition is, accordingly, dismissed as withdrawn.

In case, such a petition is filed before the Court below within a period of four weeks from today, the Court below shall take into account that the dispute arose between the agnates at the time of measurement of land and that the petitioner is not stated to have repeated his blow and that he is a person of clean antecedents and, thereafter, shall pass orders in accordance with the law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
