Mr.Arun Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-07-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Nagar P.S. Case No. 319/2018, instituted for offences under Section(s) 341, 323, 307, 354(B), 365, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the victim girl, after being released from the remand home, is living with this petitioner, which is mentioned in para 11 of bail petition.

Victim has given statement under Section 164 Cr.P.C. (Annexure-2), wherein she has stated that she had voluntarily gone to Delhi, where she met with this petitioner. She has stated that false case has been filed by her father. It is alleged in the written report that daughter of

Patna High Court CR. MISC. No.33580 of 2019(3) dt.18-07-2019 2/2 informant was kidnapped by this petitioner along with other accused persons.

Victim has stated her age in her statement recorded under Section 164 Cr.P.C. to be 19 years. The court has assessed her age to be 18 years. In medical report her age has been assessed between 18-19 years.

Petitioner is in custody since 31.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nagar P.S. Case No. 319/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
