The petitioners seek anticipatory bail in connection with Complaint Case No. 298/2018 ( Trial No. 3573 of 2018), registered for offences punishable under Sections 498 (A) of the Indian Penal Code.
Allegation as per F.I.R. against the petitioners, who happens to the husband, father-in-law and mother-in-law of the complainant, is of subjecting his wife with cruelty with respect to demand of dowry and ousted her from his house. Submission of the learned counsel for the petitioners is that the allegations against the petitioners are false and concocted and they are still ready to keep her with full dignity
Patna High Court CR. MISC. No.77318 of 2018(3) dt.12-04-2019 2/3 and care and they have no criminal antecedents. Learned counsel for the A.P.P. opposes the prayer for bail. It appears that notice issued to Opposite Party No. 2 is validly served as per office notes dated 13.03.2019 and she appears by filing vakalatnama.
Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioners, above named surrenders within a period of six weeks from the receipt of this order/orders and on surrender the petitioners file an undertaking that they will keep the complainant with dignity and care and is ready to take her from the Court/her house and if such a petition is filed, they shall be released on provisional bail for a period of one year by the court below to its own satisfaction. Petitioner No. 1 shall take the opposite party No. 2 to his home and in the meantime, the learned Court below shall issue notice to the Complainant/Opposite Party No. 2 to appear before the Court below in the first week of every month and petitioner No. 1 shall also be present for watching their conduct and marital relationship and once on realization of their marital relationship and conduct, their bail bond shall be confirmed otherwise, the Court is free to pass any order as it may deem fit and proper.
