1. Heard the parties
2. The petitioner seeks regular bail in connection with Excise P. S. Case No. 1013 of 2026 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The main submissions advanced by the petitioner's counsel are that the petitioner is innocent and has been falsely implicated in the present case and he has no criminal antecedent and has been languishing in jail since 03.04.2026 and further the alleged recovery has been made from a field accessible to all and not from the conscious possession of the petitioner and the petitioner is not the owner of the said field. It is further submitted that there is no independent witness to support the prosecution version and the petitioner has been

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the petitioner's fair and clean antecedent, his custody period, this court is inclined to enlarge the petitioner on bail, accordingly, let the petitioner namedabove be enlarged on bail in connection with Excise P. S. Case No. 1013 of 2026 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
