JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 The petitioners apprehend their arrest in connection with Town P.S.Case No. 425 of 2018 registered under Sections 307, 323, 341, 379, 420, 504 and 506/34 of the Indian penal Code. Allegation against the petitioner is that petitioner nos. 1 and 2 have executed a deed of agreement after taking consideration money of Rs. 2 lacs in favour of informant but later on he came to know that there are some wrong entries made io the agreement and as such he refused to take the land and asked them to return the money upon which petitioners assaulted him by lathi and danda.
Submission of learned counsel for the petitioners is that
Patna High Court Cr.Misc. No.78191 of 2018(2) dt.07-01-2019 2/2 petitioners have been falsely implicated in this case and they are still ready to return Rs. 2 lacs in favour of O.P. No. 2. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, with a bank draft of Rs. 2 lacs in favour of the O.P. No. 2 and if same is produced and is handed over to the O.P.-2, the petitioners shall be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Town P.S. Case No. 425 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
