The petitioner seeks regular bail in connection with Muzaffarpur Sadar Police Station Case No. 442 of 2020, registered for the offences punishable under Sections 420/467/468/471/120-B/34 of the Indian Penal Code. This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 07.04.2021, passed in Criminal Misc. No. 38090 of 2020, giving liberty to the petitioner to renew his prayer for bail after framing of charge.
The allegation, as per the First Information Report, is

No.42272 of 2021(2) dt.18-08-2021 2/3 that the police intercepted one scooty and one motorcycle and the persons riding therein attempted to flee away, but they were caught and the police recovered mobile phones, debit cards of different banks, ATM card and from the shop of petitioner, one laptop and one cloning machine were also recovered. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of the confessional statement of the arrested co-accused persons. He further submits that the petitioner is in custody since 14.08.2020 and charges have been framed in this case on 08.04.2021. He further submits that co-accused persons, namely, Rajan Ram, Abhishek Kumar and Arjun Ram, have been granted regular bail by co-ordinate benches of this Court.
Regard being had to the submission advanced on behalf of the parties and taking into consideration the materials on record, the observation made by this Court in Criminal Misc. No. 38093 of 2020, and the fact that the petitioner is in custody since 14.08.2020, charges have been framed and this the second attempt on behalf of the petitioner for grant of regular bail, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail,
Patna High Court CR. MISC. No.42272 of 2021(2) dt.18-08-2021 3/3 upon furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Muzaffarpur Sadar Police Station Case No. 442 of 2020.
