Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Allegation against the petitioner is that he pierced the dagger near the waist of Samsher Alam, as a result whereof, Shamsher Alam died. Petitioner is in custody since 22.03.2017. In the past, prayer for bail of the petitioner was refused on 12.02.2018 with direction to the learned trial judge to conclude the trial within nine months.

The recent report of the learned trial judge dated 09.08.2019 would reveal that the case was committed to the

Patna High Court CR. MISC. No.36610 of 2019(3) dt.18-09-2019 2/2 court of Sessions on 09.08.2019.

Considering the entire facts, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Garkha Police Station Case No.130 of 2017, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
