Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Kargahar P.S. Case No. 86 of 2021 for the offence registered under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act and Section 12 of the POCSO Act.

Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner. It is

No.43111 of 2021(2) dt.22-10-2021 2/2 further submitted that except the confessional statement of coaccused Manish Kumar, there is no any villager including the informant (victim) has taken the name of the petitioner. It is further submitted that no overt act has been alleged against the petitioner.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - 6th -cum- Special Judge (POCSO) Rohtas at Sasaram in connection with Kargahar P.S. Case No. 86 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
