2. The accused/petitioner seeks bail in connection with Paroo P.S. Case No. 179 of 2015 registered for the offences under Sections 366, 364, 120(B), 420 of the Indian Penal Code.
3. The accused/petitioner is named in the First Information Report and is in custody since 16.12.2025.
4. Allegation against the petitioner is to kidnap the grand-daughter of the informant for the purpose of illicit intercourse/marriage with another person.
5. It is submitted by learned counsel appearing on behalf of the petitioner that after recovery, the victim made her statement under Section 164 of the Cr.P.C. where she
Patna High Court CR. MISC. No.34137 of 2026(3) dt.17-07-2026 2/3 categorically stated that co-accused Dharmendra Gosai established physical relationship with her against her will and this petitioner was only helping to drop her to village from Banglore.
6. While concluding argument, it is submitted that petitioner is a man of clean antecedent and, moreover, investigation of this case is already concluded, for which charge-sheet has been submitted and as such, there is no chance of tampering with the evidence.
7. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
8. In view of aforesaid factual submission and by taking note of the fact as allegation of sexual assault is not appearing against this petitioner, rather same is against coaccused Dharmendra Gosai, coupled with the fact that petitioner, who is a man of clean antecedent, remains in custody since 16.12.2025, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial
