The allegation against the petitioner is that himself and other accused caused the death of Neha Kumari, his daughter-in-law. Though the name of the petitioner did not figure as an accused in the FIR, he appears to have been arrested on the basis of subsequent investigation. The learned trial judge has rejected the bail application of the petitioner repeating the contention and stating that he is not inclined to grant bail.

It is brought to the notice of this Court that the son of the petitioner, who is the husband of the deceased, has been granted anticipatory bail and other accused are at large. No direct

Patna High Court Cr.Misc. No.37546 of 2014 (2) dt.14-01-2015 2/2 allegation of overt act was attributed to the petitioner. Therefore, Cr. Misc. No.37546 of 2014 is allowed. The petitioner, namely, Shiv Sagar Sao @ Bedio Sahab @ Shivhagar Sao shall be released on bail on furnishing bail bond of Rs.10,000/- (Rs. ten thousand) with two sureties of the like amount each to the satisfaction of the Ad hoc Additional District & Sessions Judge-V, Patna, in connection with Sessions Trial No. 496 of 2014 arising out Phulwarisharif (Janipur) P.S. Case No.382/2013 dated 6.7.2013.
