2. Petitioner apprehends arrest in connection with Harnaut P.S. Case No. 523/2023 registered for the offence under Section 394 I.P.C.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the petitioner is not named in the F.I.R. and his name has been surfaced from the confessional statement of co-accused Raj Kumar. Learned counsel further submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner has no criminal antecedent.
4. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.35729 of 2024(2) dt.10-06-2024 2/2 anticipatory bail of the petitioner.
5. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM- 1st Class, Biharsharif in connection with Harnaut P.S. Case No. 523/2023 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
