Heard learned counsel for the petitioner as well as, Sri. J.N. Thakur, learned APP for the State.

The petitioner apprehends his arrest in connection with Basantpur P.S. Case No. 236 of 2021, registered for the offences punishable under Sections 304, 306, 34 of the Indian Penal Code and Section 3/4 Dowry Prohibition Act. The petitioner is husband of the deceased Reena Devi. The informant is brother of the deceased Reena Devi. The informant has stated that his sister was married to the petitioner 15 years ago. The petitioner and her matrimonial inmates used

Patna High Court CR. MISC. No.33189 of 2022(3) dt.09-01-2023 2/3 to torture his sister. She was residing in a tenanted house of Ranjit Prasad along with her husband. Due to torture she committed suicide on 11.06.2021.

Learned counsel for the petitioner has submitted that the couple were residing in a tenanted house of Ranjeet Prasad whose statement has been recorded in paragraph No. 8 of the case diary in which he has stated that the dead body of Reena Devi was found hanging with the ceiling fan. This witness has also stated that Reena Devi was not mentally fit and there was some altercation between the couple regarding construction of house. Khusboo Kumari, the daughter of the decased Reena Devi, in paragraph No. 12, has stated that her mother was in depression and she was asking the petitioner to construct a house and leave the tenanted portion and she committed suicide after hanging herself.

On the other hand, learned Addl.P.P., Sri J.N. Thakur has opposed the prayer for bail and submitted that there is allegation that the petitioner used to assault and torture the deceased.

The statements of the witnesses show that the deceased was in depression and she has committed suicide. Considering the above-mentioned facts and

No.33189 of 2022(3) dt.09-01-2023 3/3 circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Siwan in connection with Basantpur P.S. Case No. 236 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
