JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Official Excise Case No.-C2A-03/18, disclosing offences under Section 20(b) of the NDPS Act. Prosecution case is that after getting a secret information a raid was conducted at a house of Chandradeep Mahto, where 370 kg. Ganja were seized but the accused Chandradeep Mahto had succeeded in fleeing.

Later on after investigation police submitted prosecution report as annexure-2, in which the name of the petitioner also transpired as an offender.

Submission of the learned counsel for the petitioner is that petitioner has falsely been implicated in this case and nothing was recovered from his conscious possession.

Heard learned A.P.P. also.

No.30521 of 2019(4) dt.19-07-2019 2/2 Having heard both sides, in view of that facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on the basis of the materials available on record and if possible be disposed off on the same day.
