1. Heard learned counsel for the parties.

2. The petitioner in this application prays for bail apprehending his arrest in connection with Complaint Case no.9282(C) of 2023 registered for the offence punishable under sections 498A, 326, 341 and 506 of the Indian Penal Code.

3. As per the prosecution case, the petitioner was married to the complainant on 20.1.2016. Soon thereafter the accused persons including the petitioner herein who happens to be the husband of the complainant started to torture the complainant leading to an FIR and on final form having been submitted after investigation, the complainant filed a protest

4. Learned counsel for the petitioner submits that the petitioner who happens to be the husband of the complainant has been falsely implicated in the case. He filed Matrimonial Case no.236 of 2022 on 27.6.2022 whereafter an FIR being Ramkrishna Nagar P.S. Case no.439 of 2022 was filed by the complainant on 19.8.2022. On investigation, the allegations levelled therein was found to be false and final form was submitted not sending up the petitioner. However, on a protest being filed, the same was treated to be complaint and after enquiry, cognizance was taken, thus requiring the petitioner to move the instant application for anticipatory bail. It is further submitted that the petitioner has been falsely implicated in the case will also be evident from the fact that final form was submitted.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the complaint, the history of litigations as noted herein above, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks,

No.36269 of 2025(2) dt.05-06-2025 3/3 be released on anticipatory bail in connection with Complaint Case no.9282(C) of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna.
