The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 341, 323, 307, 302, 504, 379/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the father of the informant went in the company of Shyam Babu when others assaulted with fists and slaps and this petitioner resorted to firing. However, the informant came to know about the occurrence through Shyam Babu, who is in his statement recorded under Section 161 Cr.P.C. has stated that others resorted to firing along with this petitioner.
Patna High Court Cr.Misc. No.13137 of 2014 (7) dt.01-07-2015 2/2 It is submitted by learned counsel for the informant that all the non-official witnesses have been examined including the informant and only doctor and I.O. are left to be examined.
Considering the advance stage of the trial, this Court is not inclined to interfere. However, it is expected from the S.P., Motihari to produce the doctor and the I.O. on the next date fixed in the trial and it is expected from learned Additional Sessions Judge-IV, East Champaran at Motihari to conclude Sessions Trial No. 151 of 2013 arising out of Patahi P.S. Case No. 39 of 2011 expeditiously.
