PP for the State.

This is an appeal under Section 14 A (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter in short referred to as the SC/ST Act), against the refusal of prayer of anticipatory bail vide order dated 25.04.2025 passed by learned Exclusive Special Judge (SC/ST POA Act) in connection with Salimpur P.S. Case No. 69 of 2025 registered under Sections 126(1), 115(2), 109, 352, 351(2), 3(5) of the B.N.S. and Sections 3(r) (i)/3(1)(s)/3(2)(va) of the SC/ST Act.

3. As per the prosecution story, the informant alleged that as the 'shradh' of her elder father-in-law was to be performed, the villagers were invited. In course of that, when he went to the place of the appellants, infuriated, firstly he was abused by taking caste name and then all the accused persons assaulted, he was immediately shifted to Patna Medical College & Hospital, where his condition was serious. This led to the case. As the story unfolds, subsequently, the informant's husband succumbed to the injuries.

4. Learned counsel for the appellants submits that the informant is not an eye-witness and exaggerated FIR is there.

5. Learned Spl.PP on the other hand opposes the prayer submitting that a perusal of the FIR clearly manifests that only because he invited the appellants' side to the 'shradh' program at his home, was assaulted brutally, which led to his death.

6. Considering the allegation that has come, there is no need to take a look on the order passed by the learned Sessions Judge. Accordingly, the appeal is dismissed. (Rajiv Roy, J) anand/- U T
