JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 This is an application for grant of anticipatory bail in connection with Bihpur (Jhandapur) P.S. Case No. 226 of 2016 (G.R. No. 742/2016), disclosing offences under Sections 498A, 307, 420, 34 of the Indian Penal Code and Section 3/4 of D.P. Act.
Allegation against the petitioner is of demand of dowry and committing torture to the complainant/informant, who happens to be his wife.
Submission of learned counsel for the petitioner is that no marriage was solemnized with the informant and the petitioner is married with other lady.
Heard learned A.P.P. also, who has opposed the prayer
Patna High Court Cr.Misc. No.78309 of 2018(2) dt.08-01-2019 2/2 for anticipatory bail of the petitioner stating that several photographs of the marriage have also been produced before the court.
Having heard both sides, considering the above facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
Accordingly, this application is dismissed.
