2. The learned counsel for the petitioner submits that by way of filing the present application he wants to add the petitioner of this criminal miscellaneous case to be added as party in Cr. Revision No.8 of 2023 on the ground that the said Cr. Revision No.8 of 2023 has arisen from Brahampur P.S. Case No.319 of 2019 in which the petitioner was the informant.

3. Learned counsel for the State raised preliminary objection and submits that the case of the petitioner is not maintainable due to the reason that the said Cr. Revision No.8 of

Patna High Court CR. MISC. No.45077 of 2023(3) dt.06-10-2023 2/2 2023, in which the present petitioner wants to add as party respondent, has already been decided on 21.03.2023 and there is no any pending Cr. Revision No.8 of 2023 before this Court. Learned counsel for the State further submits that the present case has arisen from P.S. case and in the police case informant is not necessary to be heard at the level of revision. He submits that the leave sought by the petitioner cannot be allowed as not maintainable.

4. After hearing the parties it transpires to this Court that criminal revision has already been disposed of and petitioner was not party in the said criminal revision which has already been disposed of vide order dated 21.03.2023.

5. In this view of the matter, the relief prayed by the petitioner cannot be granted. Hence, this criminal miscellaneous application is hereby dismissed.
