Petitioner apprehends arrest in a case registered for the offence punishable under Sections 188, 420 of Indian Penal Code and Section 23 of Pre-Conception & Pre-Natal Diagnostic Techniques Act, 1994.
As per prosecution case, accusation against this petitioner is that he was running a pathology center in the name of M.S. Ultrasound and M.S. Pathology without valid licence. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that pathology center in question was yet to be started. Petitioner has simply purchased some furniture in a rented room and was about to start the clinic and applied for

No.33430 of 2022(2) dt.15-11-2022 2/2 licence before Incharge Medical Officer, Sidhwalia who demanded illegal money and when petitioner refused to fullfil the illegal demand this false and concocted case was lodged against him. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Gopalganj in Mohammadpur P. S. Case No. 23 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
