JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Forest Case No. 34 of 2018, arising out of Forest P.N. No. 2285 of 2018, registered for the offences punishable under Sections 5, 7, 8, 9 and 12 of the Bihar Chiran Cast Chiran Act, and Section 33(c), 41 and 42 of Bihar Forest Act.
Petitioner happens to be the owner of saw mill and the allegation against him is that he was illegally running saw mill but submission on behalf of the petitioner is that the saw mill of the petitioner was closed at the time of alleged raid but the forest officials, with mala fide intention, lodged the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition
Patna High Court Cr.Misc. No.73489 of 2018(2) dt.20-12-2018 2/2 is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Forest Case No. 34 of 2018, arising out of Forest P.N. No. 2285 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Spd/- U T
