Upon perusal of the Writ Petition, it appears that the petitioner has filed this Writ Petition for a direction to Respondent No.6 for production of selection letter issued in favour of Respondent No.9 by which, respondent No.9 was appointed as Aanganwari Sevika of Centre No.102 under Ward No.1 of Balia Gram Panchayat and upon production of the same, it may be quashed, on the ground that the same has been

Patna High Court CWJC No.10951 of 2019(3) dt.23-09-2024 2/2 issued in contrary to the decision of Aam Sabha dated 13.03.2018. The further prayer has been made for a direction to the respondent authorities for appointment of petitioner as Aanganari Sevika.

3. Learned Counsel for the State submits that a counter affidavit has been filed bringing on record the appointment the appointment letter at page -23, contained in Annexure -C series. Counsel for the State further submits that the said appointment has not been challenged by the petitioner. If the petitioner is aggrieved with the said appointment, he may challenge the same under the relevant Margdarshika prepared for appointment of Aanganwari Sevika and Sahayika.

4. In the aforesaid background, the Writ Petition stands disposed off granting liberty to the petitioner to challenge the appointment of Respondent No.9 before the appropriate forum in the light of the relevant Margdarshika prepared for the appointment of Aanganbari Sevika and Sahayika within 30 days from today, if cause of action still survives.
