2. Petitioner seeks regular bail in connection with Tankuppa P.S. Case No. 22 of 2026 registered for the offence punishable under section 30(a) of the Bihar Prohibition & Excise Act.

3. The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of 800 litres of illicit country-made liquor and the same is stated to have been recovered from four motorcycles near the railway track but in fact the petitioner has no concern with the said motorcycles or the seized liquor and was not apprehended at the spot and nothing incriminating was recovered from his conscious possession and the name of the petitioner surfaced in the present matter on the basis of confessional statement of coaccused Santosh Kumar @ Rocky. It is lastly submitted that the

4. Learned APP for the State has opposed the prayer of the petitioner.

5. In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with petitioner's fair and clean antecedent and also the fact that the petitioner was not apprehended at the spot and his name surfaced later in the statement of co-accused Santosh Kumar @ Rocky, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Tankuppa P.S. Case No. 22 of 2026.
