JUSTICE CHAKRADHARI SHARAN SINGH) 21-01-2022 The matter has been taken up for online hearing through video conference because of COVID-19 pandemic restrictions.

Petitioner has remedy of appeal against the order dated 30.07.2020 passed by the Licensing Authority-Cum-SubDivisional Officer, Sadar Ara, Bhojpur, whereby the petitioner PDS Licence No.134/16 has been cancelled under the provisions of Bihar Targeted Public Distribution System (Control) Order, 2016 (in short, "Control Order"), which he has not invoked.

In such view of the matter, this application is disposed

Patna High Court CWJC No.3605 of 2021(2) dt.21-01-2022 2/2 of with a liberty to the petitioner to prefer appeal before the appellate authority against the said order.

It is observed that if the petitioner files an appeal within four weeks from today, with an application seeking condonation of delay, the appellate authority, considering the present COVID-19 pandemic situation and the pendency of this application before this Court, shall consider the same liberally and decide the petitioner's appeal on merits within the time prescribed under the Control Order, 2016.
