This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 07.04.2015 passed by the learned Additional Sessions Judge, 7th, Gaya, in Sessions Trial No. 133 of 2014 by which the learned Sessions Judge has rejected the petition of the petitioner filed under Section 228 Cr. P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

Report with regard to present stage of trial was called for from the court below which has been received. From the report, it appears that charge has already been framed in the case on 23.07.2015 and one witness has been examined.

Therefore, this Court is not inclined to interfere with the impugned order.

This Criminal Miscellaneous application is accordingly dismissed.
