The petitioner apprehends his arrest in Kudra P.S. Case No. 144 of 2020, registered for the offences punishable under Sections 21(A), 20 and 22 of the NDPS Act. On secret information, raid was conducted and one co-accused Rajan Kumar Gupta @ Munmun was apprehended while selling Ganja and Heroin from whose possession 1.5 gram of Heroin and 30 gram of Ganja and cash of Rs. 600/- were recovered who disclosed the name of this petitioner, as supplier of Heroin.
It is submitted that petitioner has been falsely implicated in this case. Nothing has been recovered from conscious possession of this petitioner. Save and except
Patna High Court CR. MISC. No.31507 of 2020(2) dt.20-01-2021 2/2 confessional statement of co-accused, there is no material against this petitioner. Petitioner has got clean antecedent, as stated in para 3 of the petition.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Kaimur at Bhabua in connection with Kudra P.S. Case No. 144 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
