This application for anticipatory bail arises out of Buxar Town P.S. Case No. 421 of 2018/G.R. No. 2624 of 2018 disclosing offences under Sections 419, 420, 467, 468, 471 and 120(b) of the Indian Penal Code.
Allegation against the petitioner is of having attempted to obtain employment as guest teacher in schools in the district of Buxar by furnishing forged certificates, based on which, he was selected.
Learned counsel appearing on behalf of the petitioner has submitted that entire selection process of the District of Buxar has, however, been cancelled. According to him, the petitioner has not forged any document and has been selected on
Patna High Court Cr.Misc. No.69566 of 2018(2) dt.17-12-2018 2/3 the basis of the duly issued certificates by the Board/University. He has also submitted that another co-accused Pankaj Kumar Singh has been granted anticipatory bail by this Court's by order dated 08.12.2018, passed in Cr. Misc. No. 61679 of 2018.
Learned counsel for the State, on the other hand, has opposed the prayer for anticipatory bail and has submitted that the petitioner cannot claim parity with the said co-accused, Pankaj Kumar Singh, on the basis of the nature of allegation. He submits that whereas the petitioner would have been a direct beneficiary, said Pankaj Kumar Singh was working as Computer Operator, who is alleged to have indulged in malpractices. Be that as it may, since the petitioner has not been appointed on the basis of the forged document, which he said to have submitted for his appointment in the districts of Bhojpur and Buxar, this application is allowed. I have taken into account the submission that the petitioner is said to be working as guest teacher in Rohtas district upon selection, based on similar selection process.
Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten
Patna High Court Cr.Misc. No.69566 of 2018(2) dt.17-12-2018 3/3 thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buzar Town P.S. Case No. 421 of 2018 G.R. No. 2624 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
