The petitioner seeks bail in a case registered under Section 304(B)/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to non-fulfilment of demand of dowry.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.10.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. In course of investigation it has come that the deceased is said to have committed suicide. After investigation the police submitted charge sheet under Section
Patna High Court CR. MISC. No.30143 of 2019(3) dt.02-07-2019 2/2 306 of I.P.C. Hence no offence under Section 304(B) of I.P.C. is made out.
On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District Judge IV, Gaya in connection with S.T. No.49 of 2019/ 97 of 2019 arising out of Bodh Gaya P.S. case No.587 of 2018. (Sudhir Singh, J) Narendra/- U T
