2. The petitioner seeks regular bail in connection with Sasaram Nagar P.S. Case No. 707 of 2023 for the offences registered under Sections 341, 323, 302, 307, 504, 506 of the Indian Penal Code and Section 27 of Arms Act.

3. As per the prosecution case, on the alleged date of occurrence while Afroz @ Chikku, Chand Khand and Sanu Rahman going towards Alamganj, on the way nine accused persons including the petitioner arrived there and some hot talk exchanged between them. It is further alleged that co-accused Naushad Raines @ Lallu fired pistol in the stomach of one Afroz @ Chiku as a result of which he died on the spot and thereafter coaccused Sonu Raine fired at Sonu Rahman which hit his leg.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.35254 of 2024(2) dt.10-05-2024 2/2 petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. There is no specific allegation against the petitioner. He has no criminal antecedent. He has no concern with any money transaction with the informant and her family members. He is in custody since 21.12.2023. It is further submitted that similarly situated co-accused, namely, Gulshor Quraishi @ Md. Gulser Quraishi @ Md. Sameer Alam has already been granted bail by this Court vide order dated 18.01.2024 passed in Cr. Misc. No. 81596 of 2023. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Sasaram Nagar P.S. Case No. 707 of 2023.
