1. Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 304 (B), 34 of the Indian Penal Code.

3. It is a case of dowry death.

4. Petitioner is mother-in-law of the deceased. She is separate in mess and business and has got no concerned with the affairs of couple. Allegation is general and omnibus. The other co-accused namely Dharmendra Mistry and Babli Devi have been granted anticipatory bail on 16.08.2022 in Cr. Misc. No. 70845 of 2021. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Hilsa, Nalanda in connection with Ekhangarsarai P.S. Case No. 38 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
