2. The petitioners apprehend their arrest in connection with Bihariganj P.S. Case No. 403 of 2024 instituted under Sections 137(1) and 87 of Bharatiya Nyaya Sanhita.

3. As per the prosecution case, co-accused persons including these petitioners kidnapped the daughter of informant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that petitioners are sister and brother-in-law of co-accused Niraj Mukhiya. There is love affair between co-accused Niraj Mukhiya and daughter of informant.

Patna High Court CR. MISC. No.32756 of 2025(2) dt.19-05-2025 2/2 Petitioners have no concern with the affairs of the co-accused. As per medical report, age of the victim has been assessed between 18-20 years. Co-accused Niraj Mukhiya is already in judicial custody. Petitioners have got clean antecedent and they undertake to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 403 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
