26-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Maniyari P.S. Case No. 63 of 2021, registered for the offence under Sections 272, 273, 302, 328, 34 of the Indian Penal Code and Section 34 of the Bihar Prohibition and Excise Act.

As per the prosecution case, on an information that one persons namely Guddu Sah has died due to consumption of spurious liquor, the informant, who is police officer, went at the place of occurrence, where brother of deceased disclosed the name of petitioner and other persons, who are indulged in the business of illicit liquor and further alleged that deceased died due to consumption of spurious liquor sold by them. It is submitted on behalf of petitioner that petitioner, who is lady, has been falsely implicated in this case. As per FIR itself, the deceased has died in the shop of co-accused Mithun Kumar and petitioner has got no concern either with co-accused

Patna High Court CR. MISC. No.42218 of 2021(2) dt.26-10-2021 2/2 Mithun Kumar or his shop. Petitioner has been made accused in this case because she is wife of co-accused Manoj Rai. Petitioner has got clean antecedent and she is in custody since 28.02.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Maniyari P.S. Case No. 63 of 2021.
