====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-01-2022 Heard the parties through video conferencing. Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner, who is in custody since 10.04.2021, seeks regular bail in connection with Madanpur P.S. Case No. 230 of 2012 for the offence punishable under Sections 396 and 397 of the Indian Penal Code.

It is a case of misuse of one day of privilege of bail. Learned counsel appearing on behalf of the petitioner submits that the petitioner was granted bail in the present case by a Bench of this Court vide order dated 03.10.2013 passed in Cr. Misc. No. 18217 of 2013 and thereafter the petitioner

Patna High Court CR. MISC. No.42403 of 2021(2) dt.24-01-2022 2/2 regularly appeared in this case till January 2021. On 18.02.2021, the petitioner could not appear before the court and for that reason his bail bond was cancelled. However it was not intentional. The petitioner surrendered in this case on 10.04.2021 and since then he is in custody.

Learned A.P.P. for the State has opposed the prayer for bail.

Considering the aforementioned facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-XII, Aurangabad in connection with S. Tr. No. 161 of 2013, arising out of Madanpur P.S. Case No. 230 of 2012, as per the terms and conditions contained in order dated 03.10.2013 passed in Cr. Misc. No. 18217 of 2013.
