The petitioners are apprehending their arrest in connection with Pakaridayal P.S. Case No. 81 of 2018 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30, 34, 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the allegation against the petitioners is that some bottles of illegal liquor were found in their premises. It is further submitted that these petitioners were not aware of the alleged recovery nor have signed in the seizure memo, thus, the petitioners may be extended the privilege of anticipatory bail.

No.74345 of 2018(3) dt.19-12-2018 2/2 Considering the aforesaid facts and circumstances of the case and that the house from which such recovery were made are in the joint possession of persons, let the petitioners, above named, in the event of their arrest/surrender before the learned counsel below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of 7th Additional Sessions Judge-cum-Special Judge Excise, Motihari (East Champaran) in connection with Pakaridayal P.S. Case No. 81 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
