The instant writ application has been filed for the following reliefs:- (i) For directing the respondent authority for transfer of the petitioner from Utkramit Madhya Vidhyalaya, Garhi, DistrictSamastipur to any school as per options of petitioner's transfer application form at Serial No.01 to 08, vide Annexure-P/5 to this petition.

(ii) For commanding the respondent authorities to take legal steps regarding transfer of petitioner on the facts and circumstances of this case.

(iii) For any other relief(s) for which this Court may deem fit and proper for consideration of this case.

3. Learned counsel for the petitioner submits that the petitioner was appointed as a Teacher in the Social Science subject at Utkramit Madhya Vidyalaya, Garhi, Block-Mohanpur, District-Samastipur and has been discharging her duties to the satisfaction of the authorities.

Learned counsel for the petitioner further submits that the petitioner applied for transfer on special grounds before the District Education Officer, Samastipur, and uploaded her application on the e-Shikshakosh portal indicating her preferences at Serial Nos.1 to 8. It is submitted that the distance between the petitioner's residence and her present place of posting is approximately 75 kilometres. It is further submitted that the petitioner is a married woman having two children and a widowed mother-in-law, who is suffering from heart disease and other ailments. The petitioner is the sole person looking after the entire family. It is also submitted that her husband, who is working as a Loco Pilot (Goods/NGC), is suffering from cervical spondylosis and is undergoing treatment at different Railway Hospitals. Learned counsel further submits that the Education Department, Government of Bihar, has issued a transfer policy vide Memo No.1729 dated 07.10.2024 permitting transfer of teachers on special grounds and, therefore,

5. On the other hand, learned counsel for the State has no objection with regard to the submissions made by the petitioner.

Considering the aforesaid facts and circumstances, respondent no.3 and the District Magistrate, Samastipur, are directed to consider the request for transfer made by the petitioner and to post her against any available vacancy from amongst the options exercised by her on the e-Shikshakosh portal. It is expected that the respondent authorities shall pass an appropriate order and post the petitioner at a place where a vacancy exists amongst the options furnished by her, within a period of eight weeks from the date of receipt/production of a copy of this order.

7. With the aforesaid observations and directions, the writ application stands disposed of.
