2. This case was mentioned for an out-of-turn hearing as the marriage of the brother of the petitioner is fixed for the day after tomorrow.

3. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 8(c) and 21(c) of the N.D.P.S. Act.

4. As per the prosecution case, 402 gms of smack was recovered from a plastic bag.

5. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that the recovered

Patna High Court CR. MISC. No.31495 of 2026(2) dt.05-05-2026 2/2 quantity of smack is of intermediate quantity and claims clean antecedent. Petitioner is in custody since 12.12.2025. The petitioner undertakes to co-operate in the case/ trial.

6. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

7. Considering the facts and circumstances of the case, let the petitioner, above named, be released on provisional bail for fifteen days from today on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court (N.D.P.S.) No. II, Patna /concerned Court below in connection with Bahadurpur P.S. Case No. 421 of 2025.

8. In the meantime, the Court below shall verify the statement of the petitioner that he has clean antecedent. If the Court below finds that the petitioner has clean antecedent then the provisional bail granted to the petitioner shall be confirmed by the Court below. If it is found that the petitioner is involved in any other case then appropriate order for cancellation of interim bail granted to the petitioner shall be passed by the Court below.
