JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was Headmaster of Primary School and there is allegation that he misappropriated the amount which was allotted for Mid Day Meal Scheme. Petitioner is in jail custody since 19.06.2014 and admittedly, the investigation of this case has already been completed.

It would appear from perusal of the record that this court directed the In-charge, District Mid Day Meal Scheme, East Champaran to submit the audit report but the same has not been brought on record though In-charge, District Mid Day Meal Scheme, East Champaran appeared before this court and disclosed that he had not received any audit report.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.37829 of 2014 (6) dt.03-03-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri D. Kumar, Judicial Magistrate, Sikrahna at Motihari in connection with Patahi P.S. Case No. 32 of 2014.
