The matter has been taken up through video conferencing.
The petitioner seeks bail in Chandan P.S. case No. 68/2019 registered u/s 399, 402 of the IPC.
The informant alleged that he got information that many criminals had assembled and they were conspiring to commit dacoity near Railway bridge. After having received such information the informant and other officials raided the place and apprehended two persons, namely, Sunil Giri and Prakash Pujahar. They are said to have disclosed the name of the petitioner and other accused persons who managed to flee away. The learned counsel for the petitioner submits that nothing has been recovered from the possession of the
Patna High Court CR. MISC. No.31437 of 2020(2) dt.01-12-2020 2/2 petitioner. The petitioner was not apprehended on the spot. The petitioner is in custody since 16.11.2019. The petitioner has already remained in jail for more than one year. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for more than one year, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Chandan P.S. case No. 68/2019.
