Mr. Manoj Kumar Singh, CGC ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with NCB Case No.13 of 2019, for the offence under Sections 20, 22 and 29/8 of the Narcotic Drugs & Psychotropic Substances Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

It is alleged that the petitioner was among the persons from whom 240 Kg. of Ganja was recovered.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the driver of the vehicle and not the owner of the vehicle carrying on Ganja. Petitioner is in

Patna High Court CR. MISC. No.36273 of 2020(2) dt.29-01-2021 2/2 custody since 24.05.2019.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 24.05.2019, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner has to deposit Rs.2,00,000/- in cash. On depositing the amount of Rs.2,00,000/-, petitioner, abovenamed, shall be released on bail on furnishing bail bond of Rs. 1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in connection with NCB Case No. 13 of 2019.

Deposit of Rs.2,00,000/- (Rupees two lakh) shall abide by final outcome of NCB Case No. 13 of 2019. (Anil Kumar Upadhyay, J) BT/- U T
