JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. The petitioner seeks bail in connection with Sikraul P.S. Case No.24 of 2020, G.R. No.446 of 2020 registered for the offence punishable under Sections 25(1-b) a, 26 Arms Act and u/s 414 of the IPC.

As per the prosecution case, on the basis of secret information, police made a raid near Sokhdham mela and caught this petitioner. It is alleged that from the possession of the petitioner several incriminating articles such as two alive magazine of 315 bore, regular rifle made of iron and wood were recovered.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case and has not

Petitioner is not concerned with the alleged offence and his name has been roped due to some ulterior motive. The signature of petitioner was forcibly taken on some blank papers, later on converting it to a seizure list whereas the alleged rifle and magazines have not been recovered from the conscious physical possession of the petitioner. The petitioner has no criminal antecedent as per para3 of the bail application and has been languishing in custody since 25.11.2020.

Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below, where the case is pending, in connection with Sikraul P.S. Case No.24 of 2020, G.R. No.446 of 2020 . (Anjani Kumar Sharan, J) pallavi/- U T
