JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-10-2022 The present writ petition has been filed seeking the following reliefs:- "1.A. An appropriate writ/order/s direction/s commanding the respondent no.1 to 4 to restore possession over main public road (Amgairmazurwa) in connection with Khata no 476 pertaining to Khesra No.1566 situated in village-Jhakra, P.SPiprakothi, Dist- East Champaran which has been illegally encroached by the respondent no.5 to 6. B. An appropriate writ for direction to the respondents to make proper enquiry and thereafter to remove construction made over public road obstructing to public to acess."

At the outset, the learned counsel for the petitioner

Patna High Court CWJC No.13377 of 2021(2) dt.14-10-2022 2/2 seeks liberty on behalf of the petitioner to approach the Circle Officer, Piprakothi, District-Motihari, for redressal of his aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Piprakothi, District-Motihari, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
